Terms of Service

Section 01
Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Next Job Partner LLC ("Next Job Partner," "NJP," "we," "us," or "our"), a Wyoming limited liability company operating primarily in the State of Texas.

NJP's services are offered to businesses located in or serving customers in Texas. These Terms are governed by Texas law where applicable to consumer-facing services, and by Wyoming law for matters of corporate structure and internal governance. See Section 18 for complete document information.

By subscribing to any NJP plan, using our services, or accessing our website at nextjobpartner.com, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

Plain language: Using NJP means you've agreed to these terms. Read them. They protect both of us.

Section 02
Description of Services

Next Job Partner provides AI-powered lead capture, qualification, and follow-up services for roofing and HVAC contractors in Texas. Our services currently include:

  • NJP Command ($597/month) — 24/7 AI voice intelligence (ARIA), dedicated toll-free number, lead qualification, SMS follow-up in under 5 minutes, real-time dashboard, call recordings, and weekly performance reports
  • NJP Command Pro ($997/month) — All features of Command, plus a real bilingual coordinator monitoring leads during business hours, active SMS lead follow-up, appointment booking, and monthly performance reviews
  • ARIA — NJP's AI voice intelligence system, trained on each client's specific business, available 24/7 in English and Spanish

All plans include a one-time setup fee of $497 charged prior to the start of service. NJP reserves the right to modify, expand, or discontinue any service feature with reasonable notice to active clients.

Eligibility

To use NJP services, you must:

  • Be at least 18 years of age
  • Be a legally operating business entity or sole proprietor in the United States
  • Have the legal authority to enter into binding agreements on behalf of your business
  • Operate a roofing, HVAC, or related home services business
  • Provide accurate and complete information during account setup

NJP reserves the right to refuse service to any applicant at its sole discretion.

Section 04
Accounts & Onboarding

Upon subscribing to an NJP plan, you agree to provide accurate business information for the purpose of training ARIA and configuring your system. This includes, but is not limited to, your services, pricing, service area, and common customer questions.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

Your dedicated toll-free number is assigned to your account for the duration of your subscription. The toll-free number remains the property of Next Job Partner LLC. Upon cancellation, you will no longer have access to or use of this number.

Billing & Payments
Setup Fee

A one-time setup fee of $497 is charged at the time of subscription, prior to the commencement of service. This fee covers system configuration, ARIA training, toll-free number provisioning, and CRM setup. The setup fee is non-refundable once work has commenced.

Monthly Subscription

Monthly subscription fees are charged at the beginning of each billing cycle following the conclusion of the 14-day free trial. Billing cycles renew automatically on a month-to-month basis until cancelled. NJP does not require long-term contracts.

Payment Processing

All payments are processed securely through Stripe. By providing your payment information, you authorize NJP to charge your payment method for all applicable fees. You represent that you are authorized to use the payment method provided.

Failed Payments

If a payment fails, NJP will notify you and attempt to process the charge again. If payment is not received within 7 days of the failed attempt, your service may be suspended until payment is resolved. Accounts suspended for more than 30 days may be terminated.

Price Changes

NJP reserves the right to change subscription pricing with 30 days' written notice to active clients. Continued use of the service after a price change constitutes acceptance of the new pricing.

Section 06
Free Trial

New clients receive a 14-day free trial beginning on the date their toll-free line goes live. The trial period does not begin until your system is fully configured and active.

During the trial period, you have full access to the features of your selected plan at no monthly charge. The one-time setup fee is still required prior to trial commencement.

To avoid being charged for your first monthly billing cycle, you must cancel your account before the end of the 14-day trial period. If you do not cancel, your monthly subscription will begin automatically at the end of the trial.

No surprises: At the end of your trial, you receive a full performance report. You decide whether to continue. We will never charge you for a monthly period you didn't knowingly agree to.

Section 07
Cancellation

You may cancel your NJP subscription at any time by contacting us at [email protected] or by calling (888) 455-7556. There are no long-term contracts and no cancellation penalties.

Cancellations take effect at the end of the current billing cycle. You will retain access to your service through the end of the period for which you have paid. Monthly fees are non-refundable once a billing cycle has begun.

Upon cancellation:

  • Your toll-free number will be deactivated and returned to NJP's number pool
  • Your ARIA configuration will be archived and deleted per our data retention policy
  • Your CRM data will be retained for 12 months and then permanently deleted
  • You will receive a final performance report for your last active period

NJP reserves the right to terminate or suspend accounts that violate these Terms, with or without prior notice depending on the severity of the violation.

Section 08
Acceptable Use

You agree to use NJP services only for lawful business purposes consistent with these Terms. You may not use our services to:

  • Violate any applicable federal, state, or local law or regulation
  • Engage in deceptive, fraudulent, or misleading practices toward callers or leads
  • Collect or process personal information in violation of applicable privacy laws
  • Send unauthorized or unsolicited communications (spam) through our SMS infrastructure
  • Attempt to reverse-engineer, copy, or replicate NJP's systems, workflows, or ARIA's configurations
  • Use our service for any business that is unlicensed or operating illegally in Texas
  • Resell, sublicense, or transfer your NJP account to any third party without written consent

Violation of this section may result in immediate termination of your account without refund.

Section 09
Call Recording & ARIA

All calls handled through your NJP toll-free number are processed by ARIA, NJP's AI voice intelligence system. By subscribing to any NJP plan, you:

  • Authorize NJP to answer, record, and transcribe all calls received on your dedicated toll-free number
  • Acknowledge that ARIA's responses are AI-generated and may not be perfect in all circumstances
  • Accept responsibility for ensuring your use of ARIA complies with applicable recording consent laws in your jurisdiction and the jurisdictions of your callers

NJP provides a call disclosure feature that announces to callers that the call may be recorded. We strongly recommend enabling this feature. NJP is not liable for any legal claims arising from failure to provide proper recording disclosures.

Important: While Texas is a one-party consent state for call recording, callers from other states may have additional rights. You are responsible for compliance with the laws applicable to your callers.

Section 10
SMS Communications

NJP sends SMS messages to leads and callers on your behalf as part of the lead follow-up service. By subscribing to NJP, you represent and warrant that:

  • You have a legitimate business relationship with the recipients of SMS messages sent through NJP on your behalf
  • Your use of NJP's SMS services complies with the Telephone Consumer Protection Act (TCPA) and applicable state laws
  • You will not instruct NJP to send SMS messages to individuals who have previously opted out

NJP's SMS infrastructure operates through registered toll-free numbers in compliance with applicable carrier requirements. All SMS campaigns include opt-out instructions. NJP manages opt-out compliance on your behalf through our systems.

You agree to indemnify and hold NJP harmless from any claims, fines, or legal actions arising from SMS messages sent based on your instructions or through leads generated by your business practices.

Section 11
Intellectual Property

All aspects of the NJP service — including but not limited to ARIA, our workflows, automation logic, reporting systems, website, and branding — are the exclusive intellectual property of Next Job Partner LLC.

You retain ownership of your business information provided during onboarding and the lead data generated from your calls. You grant NJP a limited license to use this information solely for the purpose of delivering and improving the service.

Nothing in these Terms transfers any NJP intellectual property rights to you. You may not copy, reproduce, or create derivative works based on NJP's systems or service without express written permission.

Section 12
Disclaimers

NJP services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The service will be uninterrupted, error-free, or completely secure at all times
  • ARIA will respond perfectly in every call scenario or language variation
  • The number of leads captured will meet any specific expectation or target
  • Results experienced during a trial period will continue or replicate during paid subscription

NJP is a lead capture and qualification service. We do not guarantee that captured leads will result in closed jobs or specific revenue outcomes. Results depend on factors outside our control, including market conditions, your sales process, and the quality of incoming leads.

Section 13
Limitation of Liability

To the maximum extent permitted by applicable law, Next Job Partner LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost business opportunities, or data loss, arising from your use of or inability to use our services.

In no event shall NJP's total cumulative liability to you for any claims arising from these Terms or your use of the service exceed the total amount paid by you to NJP in the three (3) months immediately preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

Section 14
Indemnification

You agree to indemnify, defend, and hold harmless Next Job Partner LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of NJP services in violation of these Terms
  • Your violation of any applicable law or regulation
  • Your failure to provide proper call recording disclosures to your callers
  • Any claim by a third party related to SMS messages sent on your behalf
  • Inaccurate or misleading information provided during account setup
Section 15
Dispute Resolution

Because NJP's services are offered to and consumed by businesses and consumers in Texas, these Terms are governed by the laws of the State of Texas with respect to service delivery, consumer rights, and contractual obligations — without regard to its conflict of law provisions. Matters of corporate structure and internal governance are governed by Wyoming law, the state of NJP's incorporation.

Before initiating any formal legal proceeding, both parties agree to attempt to resolve any dispute informally by contacting NJP at [email protected]. We will make a good-faith effort to resolve disputes within 30 days.

If informal resolution fails, any dispute, claim, or controversy arising from these Terms shall be resolved by binding arbitration. Arbitration shall take place in the State of Texas or remotely by mutual agreement, and shall be administered under the Commercial Arbitration Rules of the American Arbitration Association (AAA).

You waive any right to participate in a class action lawsuit or class-wide arbitration.

Section 16
Changes to Terms

NJP reserves the right to modify these Terms at any time. When we make material changes, we will notify active clients by email and update the effective date at the top of this page.

Continued use of NJP services after any modification constitutes your acceptance of the revised Terms. If you do not agree with changes, your sole remedy is to cancel your subscription before the changes take effect.
